Lukwago Awaits Crucial Court Decision After Lawyers Cite Medical Risks in Detention

KAMPALA — Former Kampala Lord Mayor and People’s Front for Freedom (PFF) leader Erias Lukwago is expected to learn his fate this afternoon when the Makindye Chief Magistrate’s Court delivers its ruling on his bail application.

The court is scheduled to rule at 2pm following submissions from both the prosecution and the defence, with Lukwago’s lawyers arguing that his deteriorating health requires urgent medical attention outside prison.

Lukwago was last week charged with misprision of treason and remanded to Luzira Prison pending the hearing of his bail application. Prosecutors allege that he failed to report information relating to an alleged treason plot involving opposition figures, including Dr Kizza Besigye and others. Lukwago has denied the allegations, maintaining that the individuals named in the charge sheet were his clients and that any information he received was protected by lawyer-client privilege.

During the bail hearing, defence lawyers led by Medard Sseggona told court that their client suffers from several medical conditions that have worsened since his arrest and detention. They said Lukwago requires specialised treatment, continuous medical supervision and a carefully managed diet.

According to the defence, Lukwago has a history of chronic gastritis, hypertension and respiratory complications. His lawyers also informed court that he previously underwent spinal surgery involving the insertion of a metal implant after suffering a cervical disc condition. They argued that the physical circumstances surrounding his arrest and detention aggravated the condition, leaving him in severe pain and requiring urgent medical care.

The defence further claimed that Lukwago experienced health complications while in custody and warned that continued detention could worsen his condition. They asked the court to consider his medical needs, permanent residence and status as a senior advocate as grounds for granting bail.

Prosecutors, however, requested time to verify the medical records and documentation presented by the defence before responding fully to the application. The State has also maintained that investigations into the case are still ongoing.

In an earlier ruling, Chief Magistrate Sarah Basemera directed prison authorities to take Lukwago’s health concerns into consideration while he remains on remand. The court also allowed his family to coordinate with prison officials regarding the provision of an orthopaedic mattress recommended for his condition.

The case has attracted widespread public attention due to Lukwago’s prominent role in opposition politics and his position as a member of Dr Besigye’s legal team. Human rights organisations, legal bodies and opposition leaders have raised concerns about both his arrest and detention, arguing that the matter carries broader implications for the legal profession and political freedoms in Uganda.

As supporters, lawyers and political observers await the court’s decision, attention is now focused on whether the magistrate will grant bail or order that Lukwago remain on remand as investigations continue.

A ruling is expected at 2pm.
